1. Scope of application and contractual relationship

These terms of use govern the contractual relationship between drivo GmbH, Konsul-Smidt-Straße 24, 28217 Bremen (hereinafter “operator”) and the users of the drivo mobile application (hereinafter “app”). With successful registration in the app and acceptance of these conditions, a free user contract is concluded.

The specific content and the scope of the respective services of the operator are determined in addition to these terms of use according to the functionalities currently available and described via the app at the time the respective contract is concluded. The operator reserves the right to change, adapt or expand functions provided free of charge at any time and/or to discontinue the provision of free functions.

2. Registration and user account

Use of the app requires registration. The following data is collected: E-mail address, password, first name, place of residence, vehicle make and model and annual mileage. Each user may only have one account. Access is not transferable. The user is responsible for the secure storage of their access data. You are responsible for all activities on your account and you undertake to keep your password safe and secret at all times. You may not have more than one account without the written permission of drivo. Upon completion of the registration process and activation of the account by the operator, a legally effective contract is concluded.

3. Functionality and functions of the App

drivo is a mobile application for recording driving data for potential use in telematics-based insurance products and digital mobility solutions. Using your smartphone and/or the drivoTag provided, you can register in the app and record your journeys by car. The recorded data is processed and made available to you in the form of scores, routes and other useful information within the drivo app.

The use of drivo requires a mobile data connection. The operator is not responsible for establishing the mobile data connection. This requires a SIM card with a corresponding data option, the content and scope of which are governed exclusively by the terms and conditions agreed with your telecommunications provider. It is recommended that you choose a mobile phone tariff with sufficient data volume. You are responsible for ensuring that you have the option of mobile data communication and will bear any data transfer costs incurred from your telecommunications provider. Receiving data packets from the Internet may incur additional costs (e.g. roaming charges), depending on your mobile phone tariff and especially when using it abroad. The mobile data connection and its performance (speed) also depend on factors that are outside the operator's control and sphere of influence. These include, in particular, sufficient mobile phone reception at the location of the vehicle, interference, impairment or interruption of mobile phone reception due to tunnels, garages, underpasses or other disruptive influences (e.g. weather influences such as thunderstorms, disruptive equipment, buildings, bridges or mountains, intensive mobile phone use in the relevant radio cell, etc.). 

A claim to the use of the free services of the app only exists within the scope of our technical and operational possibilities. We will continuously take all reasonable measures to ensure the continuous availability of drivo and to eliminate any disruptions that occur as quickly as possible. Nevertheless, unavoidable temporary disruptions or a reduction in performance (speed) may occur, in particular due to force majeure (e.g. storms) or due to the implementation of necessary maintenance, repair or other measures on the operator's technical equipment or on the technical equipment of third parties who provide data, content, information or transmission capacities for the operator. 4. Technical requirements for using drivo

To be able to use drivo with all its functionalities, the following criteria for the hardware and software of your smartphone must be met:

1. iOS: I Phone, model 6 or newer with iOS version 15 or newer.   

2. Android: Smartphone with location and acceleration sensor with API version 30 (Android 11) or newer. 

3. if your smartphone does not meet the specifications described, drivo can only be used to a limited extent or not at all.

5. Tracking and Scoring

With the help of your smartphone, information about the speed, position and acceleration of the vehicle is determined and made available to you in the app as well as to drivo and selected partners. The vehicle and movement data collected during the journey is transmitted to the operator's server in encrypted form.

The data is only collected during active use (only while driving a vehicle) by drivo.

The information collected about your riding behavior can only be viewed by you, the operator and the respective partner. We will only pass on personal data relating exclusively to the tracking and scoring of your completed journeys to authorized and named partner companies, but never to unauthorized third parties.

6. Location Access in the background

In order to be able to reliably record your journeys and reliably guarantee core functions such as (automatic trip detection, accident detection, etc.) with drivo in the background, we need access to your location at all times („allow always“), even when the app is closed. The position data is used, among other things, to determine the route you have taken. Accelerations are recorded and evaluated to assess your driving style. Location access begins with motion detection and ends when the journey is complete. Location data is processed in combination with movement data from the device and, if necessary, Bluetooth beacon signals for precise driver detection. You can revoke the authorization at any time in the settings. Please note that certain app functions are not available or only available to a limited extent without this authorization.

7. Special notes and obligations

The use of drivo or our other services may not violate these terms of use, legal provisions (in particular data protection and personal rights regulations) or the rights of third parties. This also includes not integrating drivo into other websites, neither private nor commercial, or redistributing it commercially without our prior consent. In addition, you are obliged not to publish or post any content in connection with drivo that violates the law, in particular content that is illegal, offensive, hurtful, misleading, harassing, racist or glorifies violence or that illegally interferes with the privacy, personal rights or intellectual property of third parties. We reserve the right to delete such content immediately after becoming aware of it, especially if the publication or post can put drivo in any context with the illegal statement.

drivo may only be used while driving to the extent that you are not distracted from the traffic situation. The provisions of the road traffic regulations must be complied with.

8. Rights of use

Unless otherwise agreed, by activating the app, the operator grants you the non-exclusive, non-transferable and non-sub licensable right to use the app for an unlimited period of time. This also includes the right to use the content and information obtained via the app. However, this does not include the right to receive future upgrades, updates, additions, support or technical assistance, unless the operator expressly points this out in advance. In this case, these upgrades, updates or additions are also subject to these Terms of Use, unless otherwise agreed.

Unless permitted by applicable law or license terms or expressly permitted by the operator, you do not have the right to modify, reverse engineer, decompile or disassemble the operator's software, apps, services or products.

When using drivo, copyrights, name and trademark rights as well as other rights of drivo GmbH and third parties must also be observed.

9. Liability

In the event of intent and gross negligence, the operator shall always be liable without limitation in accordance with the statutory provisions. In other cases, the operator shall only be liable in the event of a breach of a contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the user may regularly rely. In this case, however, liability is limited to compensation for foreseeable and typical damage. Liability for damages resulting from injury to life, limb or health and under the Product Liability Act remains unaffected by the above limitations of liability.

The operator is not responsible for damages caused by improper use of the app. This applies in particular if the user is distracted from the traffic situation by using the app while driving and this leads to accidents.

10. Contract term and termination

The contractual relationship is open-ended and may be terminated by either party at any time without notice. Extraordinary termination for good cause remains unaffected.
